Public Hearing called to order at 7:33 PM.
~~PUBLIC HEARING:
1. Pursuant to sections 20.08.01 and 20.08.04 of the Willington Zoning Regulations regarding ZBA2014-18 Application for Special Exception to create a Center for the Arts for visual arts display, workshop, conferences, performance, film, lecture, instruction, community events, etc. in unit #1301 3,530 sq. ft.at 156 River Road Owner: Irma L. Buccino Applicant: Friends of The Mill Works
Tom Buccino was present to speak. He said that at the last meeting of Zoning Board of Appeals a letter was read from Windham Arts whom Friends of the Mill Works had a fiscal agent agreement with, Windham Arts holds the 501.c.3 non-profit status. Friends of The Mill Works originally applied for the Special Exception under the Windham Arts 501.c.3 non-profit. He said because the agreement has ended the Friends of the Mill Works has applied for its own 501.c.3 under the name Eastern Connecticut Center for History, Art, and Performance, Inc.
Tom Buccino said that he had a copy of the application for the 501.c.3 and also a copy of the application to the IRS 10243EZ for the non–profit status. The IRS says that during that period from submitting the application to the pending of approval the non-profit can proceed from the date of incorporation September 13, 2016.
T. Buccino said the use will remain the same it will just be a new name. On September 13, 2016 an application was submitted for the no-profit status.
Richard Maloney said that the Board Members had asked for an opinion from the Attorney and that the letter will be added to the record.
The Board Members reviewed the Attorney opinion stating “an approved special exception use can be continued by an entity other than the original applicant.”
The Board Members asked question about the non-profit, and the leasing of the space the non-profit will be using,
R. Maloney asked to what extent The Friends of the Mill Works will take on the lease obligation. The Leaser will be The Millworks and Eastern Connecticut Center for History, Art, and Performance, Inc. will be the lease.
The Board Members asked what happen to any revenue that exceeds the payment on the lease. T. Buccino said it would be use for programing, workshop, and classes’ with regard to visual arts, preforming arts, and assessment of the historic preservation of the building.
M. Masinda asked if anyone present wanted to speak either for or against the application.
Mary Oliver a representative of Windham Arts was present she read the letter from Windham Art that was dated October 10, 2016 and was submitted at the meeting on September 8, 2016.
M. Masinda closed the P. H. at 8:00 PM.
2. ZBA2016-10 Application for Special Exception to open an Antique/Flea market Mall selling household items, furniture, clothing and collectibles at 165 River Road Representative for Owner: Ruiling Wei Applicant: Ruiling Wei (Received and Public Hearing October 13, 2016 Decision within 65 days after close of P. H.)
Trish Place was present to speak she said that she is working with Wie Ruiling. She said that no food would be served. The days of operation would be Thursday, Friday & Saturday, and hours of operation would be on 10-6 daylight savings time and 10-8 in the summer months. She said there are two building on the property that will be used and the foot print of the building will not be changed. The buildings have existing offices and the spaces will be available to venders to set up their wares. One person will manage the two building; we will start with one building and move to the next as needed. The outer building will not be use.
M. Masinda asked about outside activity. She said maybe in the summer month the open court yard would be used for display.
The Board Members reviewed the application.
R. Maloney asked for a site plan for parking location, also location of the dumpster.
T. Place said the site can hold 40 venders. Signage will remain the same.
Judy Post was concerned about the early morning weekend hours and the site line for the entrance to the location.
Rick Maloney motion to continue the Public Hearing until November 10, 2016. Bill Bland seconded the motion. All voted in favor.
3. ZBA2016-8 Application for variance from section 4.04 Buildable Area at 61 Turnpike Road (Map 45 Lot 06 Zone DI) Owner/Applicant: Kurt Lessenger (Received September 8, 2016 Public Hearing September 8, 2016 P.H continued to November 10, 2016 decision within 65 days after close of P. H.)

Jack Rup motion to continue and the Special Exception ZBA2014-18 contingent upon Eastern Connecticut Center for History, Art, and Performance, Inc. obtaining the non-profit status and proper notification given to Zoning Board of Appeals to create a Center for the Arts for visual arts display, workshop, conferences, performance, film, lecture, instruction, community events, etc. in unit #1301 3,530 sq. ft.
The applicant Eastern Connecticut Center for History, Art, and Performance, Inc. is to submit proof and verification of non-profit.
R. Maloney seconded the motion. All voted in favor.
2. Public Hearing continued to November 10, 2016. Board Members requested additional information on parking and waste disposal location.
